State Farm covered a local guy who wrecked at an autocross, and he didn't commit fraud.

From my understanding, even insurance companies that don't "have" to cover accidents at these events usually do. It's not a clause in the contract and the people that get covered this way are just lucky.

This is so not true that it defies description.

I still have not heard of a single autocross incident related claim not being covered but know of quite a few that were (through a number of carriers). No lying, no fraud, nothing that wasn't totally above board. The fallout has been that those people have seen their carriers refuse to renew or significantly increase their rates at their next opportunity.

That's pretty amazing considering that there is a clause in State Farm stating that timed organized speed events are not covered.

Unless this guy wrecked the car during practice session, either the adjuster screwed up and covered him, or the guy did not disclose all the facts.

Of course, maybe I am overlooking another plausible explanation, but I just don't see it, especially with what's in the State Farm exclusion clause, since we actually looked into them as well.

Either way, I am interested to find out how this clause was navigated around by all parties involved.

I'm not a lawyer and can't/won't offer anything that should be construed as a legal opinion, but I find it amusing that you make a leap from your wife's legal opinion of terms in a specific policy that she's reviewed (although you've never mentioned if this is the type of law that she specializes in or has any direct experience with) to assuming that all policies issued or offered by that carrier contain the same terms even though policies are normally quite different from state to state.

I'm saying a few things:

1) I wouldn't assume that polices which I have not reviewed cover or don't cover specific things in specific situations, particularly those issued in other states.

2) Anecdotal as it may be and without knowledge of what their policies said, I have heard of quite a few people having autocross related claims honored by various carriers in various states where the circumstances were hoestly described while I have not heard of any autocross claim being denied where the circumstances were honestly described.

Whether those claims were honored as good will gestures or something like that, I can't say, and I wouldn't make assumptions about my own or anyone else's coverage based on those anecdotal examples. I'm just relating what I have witnessed in the past as opposed to speculating on potential future events.
