I've heard one similar story about BaT. I'm not sure they will protect or "make whole" the seller. The buyer will be out a certain fee (and apparently those can get refunded).

I don't think you have tremendous fraud risk... If he is in NY, what town? The timing is suspicious on the restructuring but it sounds more like buyer's remorse than fraud. Well-advertised and publicized auctions are good for sellers as buyers end up passing mental set points in the heat of competition.

It has been a day...
Good news is I am very proactive and I immediately got in contact with the 2nd highest bidder on my own. I also reached out to a local (10 min away) guy I met through BaT and knew was interested up to $11k, so I had that offer in my back pocket. The 2nd highest bidder was from NJ so local enough I didn't have to deal with shipping and remote selling hassles. He and I agreed on a deal at $12,500 and he is happily taking the car tomorrow. He saves about $1250 over his highest bid because he's not paying the BaT fees and while I'm out $750, I am still at the highest estimate I had for selling when the auction started. I called and emailed the original winning bidder to have a discussion with him and better understand his situation so I could determine what recourse I wanted to take but haven't heard back. If the guy really lost his job today, I wouldn't want to take any recourse. He's already out $600 to BaT and has much bigger issues then making me whole on this. I did send all of this information to BaT (except my soft heart to the winning bidder) to see what, if anything they will do. Realistically I got my $99 worth from them in market attention, but I'm still irked that I am losing out. Overall I'm content if I sell the car on Monday for $12,500 and everything else goes away. As i said, what a frickin day.
