I think its because they need the clearance for the hard-top roof to fit in the trunk...
If you look at most of the other hard-top cabriolets on the market (primarily in Europe - like the small Peugot and Renault ones), you'll notice the trunk cuts on the side like that too. Most of them do a better job of integrating them though (and something tells me tht Bangle doesn't like them integrated and wants the to stick out -- odd).
I saw an E93 yesterday -- the press intro was done in AZ, and one of the cars was still at BMW North Scottsdale. I had my E39 in for service yesterday, and noticed this as I was walking through the back lot after dropping off my Hertz loaner...
Here's a couple pics I took on my phone. The trunk cut line is really awkward, and up close you start to notice some other odd shapes in the roof -- in particular some hinge plates near one of the creases.
I really did not like it in person... the odd thing is that I actually like the E92 coupe design. E93 is about 99% the same, but the extra cut lines and odd extra panels just don't work.
I wonder what the deal is with the license plates.

Its a Euro-spec car that was brought in for the press intro... I didn't snap a pic, but the speedo guage is KM/H only... This month's R&T has a similar car (different color interior, but otherwise identical) with M plates, but the shots were taken in Sedona...
The press intro was done in mid Jan... I'm just wondering why that one car is still there (you really can't tell from those pics, but it had a layer of dust all over it - so it hasn't been driven much).
That dealership is part of the premier United Auto Group / Roger Penske set of dealerships. Penske has his racing museum there -- mostly with cars he raced or owned. The Audi dealership next door also had a Germany registered, Euro-spec Q7 on display for about a month a year ago, months before any US-spec Q7s were avail for sail here...
Edit - here's the Google Maps sat shot of the Penske / UAG dealerships in Scottsdale -- its quite a facility. There is another large dealership is just north of these in that map -- that is the local Mercedes dealership, which opened a year or so ago (and replaced a very small dealership). Its locally owened...

I agree -- they are prohibitevly expensive. Pricing on the E93s was recently released, and was a bit higher than I expected. The MSRP on a similarly equipped 335i is just over $10k higher on an E93 vs an E92. A ~25% premium for the convertible is a bit more than I was expecting... FWIW, I priced both with the premium, cold weather and sport packages, plus sat radio and metallic paint. Here's the MSRPs for Euro Delivery:
E92 Coupe 335i - $44,075
E93 Cab 335i - $54,465
Wait until you see one in person... the little fugly things (like the roof hinges) might make it prohibitevely ugly too...
I'm glad I saw the cab yesterday -- If I do replace my E39, it very well may be an E92 335i...

I'm just worried that the back seat will be too small! I've sat in the existing 1-series, and there is almost no rear legroom to begin with.

It can't be too much worse than my E46 cab, though. It's very tight back there, especially as the seats are moved inward to make room for the top.
I've yet to see a one series up close and personal, but if the cab loses some rear overhang as compared to an E46, my hope is the interior stays somewhat roomy for four (smallish people anyway).

Those are options. Unfortunately there's no option box to tick on the BMW order sheet like "ZNU: Make the car not ugly."
